Terms & Conditions of this Agreement
Important: Vickers Marketing Ltd is required to provide with this disclosure statement under section 17 of the Credit & Consumer Finance Act 2003. It sets out the key information about your contract, you should read it thoroughly
& if you do not understand anything you should seek independent advice. Please keep this document in a safe place.
In signing this agreement you are confirming you have given due consideration to your financial situation & can afford the purchase along with the agreed instalment value & frequency.
Total Balance: is the amount you owe when signing this agreement.
Initial Credit Limit: this agreement has a credit limit. This limit may increase or decrease during the term of your contract depending on the amount & frequency of your payments. You can enquire about your credit limit by
contacting Vickers Marketing Ltd on 0800 5 0800 5 during normal business hours
Fees & Charges: Your purchase is interest free providing you do not miss any instalments; should you fall into arrears without prior arrangement the following applies: Penalty interest 20%, Arrears text $3-$5 each
arrears letters $5-10 each, personal visit if we are required to call on you to secure a new payment authority form $50, trace fee if we are required to locate you at a new address $65 and any other reasonable recovery fee that we
may incur. If your account goes into (unarranged) credit &/or you do not respond to our attempts to contact you, you will incur cancellation, trace &/or refund fees of up to $30. Charges are subject to change
Penalty Interest: is calculated daily and charged monthly on late payments
Disclosure: Statements are issued every 6 months or can be requested at any time & by contacting our office during normal business hours.
What to do if you suffer unforeseen hardship: if you are unable to keep up your payments or other obligations due to reasonable cause you may be able to apply for a hardship variation. You can do this by making a written
applications explaining your hardship and requesting (a) a reduction in payment value (b) and extension of the terms of the agreement (c) a postponement of payments or both. Such applications should be done ASAP.
If you fail to meet your commitments: Goods belong to Vickers Marketing Ltd until paid for in full and Vickers Marketing Ltd may be entitled to repossess this property however you may still be liable for any outstanding amounts
not covered by its sale. The purchaser shall retain the product(s) and keep them in good order & repair (fair wear & tear excepted)
Payment Amendment / Alteration: Vickers Marketing ltd requires 7 DAYS notice to hold or amend a payment
Complaints or Disputes: If you are not satisfied with the service you have received from Vickers Marketing Ltd you should contact us & tell us what your complaint is about. We have an internal process & undertake to investigate your concerns promptly & fairly. In addition we are a member of an independent resolution scheme operated by Financial Services Complaints Ltd if you are not satisfied with our response you may contact them on 0800 347 257
Other Information:
You authorise Vickers Marketing Ltd to collect, retain and use information about you including but not limited to 3rd parties for the purpose of: determining your credit worthiness, administering any agreement you have with us & marketing / market research conducted by us or on our behalf
You agree to receive promotional material from Vickers Marketing Ltd by po
Should your account fall into arrears and you do not respond to our attempts to contact you, you authorise us to use any payment authority form we may hold on file to restart your payments at any equal or lesser amount to the
original instalment value.
It is your responsibility to advise us of any change in your contact details including address, phone and email. You will be deemed to have received any correspondence from us including email 7 days after we have sent it
Vickers Marketing Ltd may at law or in equity assign its rights, title and interest in the goods and or under this agreement and any of them at any time. In case of default the purchaser authorises Vickers Marketing Ltd to use the information provided by them in its efforts to recover the debt including but not limited to passing that information to a third party for recovery. The third party is also authorised to add all legitimate charges incurred.
Should an instalment fall due on a public holiday & you are paying by direct debit, your payment will be processed on the closest business day BEFORE the public holiday.

Conditions to accept direct debits
The Initiator: (1) the initiator undertakes to giving written notice to the acceptor of the commencement date, frequency and amount at least 10 calendar days b before the direct debit is drawn (but no more than 2 months) (2) in the event of any subsequent change to the frequency or amount of the direct debit the initiator has agreed to give notice at 30 days before changes come into effect (3) may, upon relationship which gave rise to this authority being terminated, give notice to the bank that no further direct debits are to be initiated under the authority, upon receipt of such notice the bank may terminate this authority.
The Customer May: (1)at any time terminate this authority as to future payments by giving written notice to the bank and the initiator (2) stop payment of any direct debit to be initiated under this authority by giving notice to the bank prior to the direct debit being paid by the bank (3) where a variation to the amount agreed between the initiator and the customer from time to time to be direct debited has been made with notice being given in terms of clause 1 above, request the bank to reverse or alter any such direct debit by debiting the amount of the reversal or alteration of a direct debit bank to the initiator through the initiators bank provided such request is made not more than 120 days from the date when the direct debit was debited to my / our account
The Customer Acknowledges that: (1) this authority will remain in full force and effect in respect of all direct debits passed to my/our account in good faith notwithstanding my/our death or other revocation of this authority until actual notice of such event is received by the bank (2) in any event this authority is subject to any arrangement now or hereafter existing between me/us and the bank in relation to my/our account (3) any dispute as to the correctness or validity of an amount debited to my/our account shall not be the concern of the bank except is so far as the direct debit has not been paid in accordance with this authority. Any other dispute lies between me/us and the initiator (4) where the bank has used reasonable care and skill in acting in accordance with this authority the bank accepts no responsibility or liability in respect of the accuracy of information about direct debits on
bank statements, any variations between notices given by the initiator and the amounts of direct debits (5) the bank is not responsible for, or under any liability in respect of the initiators failure to giving written advance notice correctly nor for the non or late receipt of notice by me/us and the initiator (6) notice given by the initiator in terms of clause 1(1) to the debtor responsible for the payments shall be effective. Any communication necessary because the debtor responsible for payments other than me/us is a matter between me/us and the debtor concerned.
The bank May: (1) in its absolute discretion conclusively determine the order of priority of payment by it of any monies pursuant to this or any other authority, cheque or draft properly executed by me/us and given to or drawn on the bank (2) at any time terminate this authority as to future payments by notice in writing to me/us (3) change its current fees for this service on force from time to time.
Right to Cancel
You are entitled to cancel this agreement by giving notice to Vickers Marketing Ltd before the end of the period of 7 days beginning the day after the day on which you signed this agreement. You can provide notice by:
(1) Giving notice to an employee or agent of Vickers Marketing Ltd (2) Posting , Emailing or Faxing notice using details provided on the front of this agreement. You must also return any goods you have taken possession of
and in "as new" condition. Vickers Marketing will arrange return of goods providing notice is received as specified. Vickers may charge you any reasonable expense that may be incurred in the administering of this agreement
and/or the collection of goods should (a) notice not be received as per above (b) goods are not returned in appropriate condition or timely manner
